Terms of Service

These Terms of Service (“Terms”) govern your use of the MoodStride mobile application and related services (collectively, the “Service”) operated by Mikita Pupko (“we,” “us,” or “our”).

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. About the Service

MoodStride is a digital tool designed to support Cognitive Behavioral Therapy (CBT) practice between therapy sessions. It helps you record thought patterns, track your mood and emotions, and, optionally, share your progress with a licensed therapist.

MoodStride is not a medical device, and it is not a substitute for professional mental-health treatment. The Service does not diagnose, treat, cure, or prevent any medical or mental-health condition. Always consult a qualified healthcare professional for medical advice.

2. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this age requirement.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Provide accurate and complete registration information.
• Notify us promptly if you suspect unauthorized use of your account.
• Not share your account with others.

We may suspend or terminate your account if we reasonably believe you have violated these Terms.

4. Pricing & Payment

The Service is currently provided free of charge. We may introduce paid plans or premium features in the future. If we do, we will give you advance notice, and any paid features will require your explicit consent before billing begins. Free-tier functionality that you already use will not be removed without notice.

5. Your Data & Privacy

Your privacy is fundamental to MoodStride. Please review our Privacy Policy for full details on how we collect, use, and protect your data.

Key principles:

• You own your data. Your diary entries, mood scores, and all personal content belong to you.
• You control sharing. No therapist can see your data without your explicit permission, and you can revoke access at any time.
• We do not sell your data. We do not use it for advertising or share it with third parties for their marketing purposes.

6. MindFlow (AI Features)

MindFlow uses artificial intelligence to transcribe your voice input and extract structured thought records (situations, beliefs, emotions). By using MindFlow, you acknowledge that:

• AI outputs are suggestions — you review and approve everything before it is saved.
• AI extraction may be imperfect — it can miss nuances, misinterpret context, or produce inaccurate results.
• Transcripts are processed by third-party AI providers. We do not send identifying information (your name, email, or account ID) along with transcripts.
• You may opt out of MindFlow at any time and use manual entry instead.

7. Therapist Connections

If you choose to connect with a therapist through MoodStride:

• You initiate or accept the connection. We never connect you with a therapist without your knowledge.
• You control access through your Access Policy (full, date range, or selected entries). You can exclude specific entries and end the alliance at any time.
• Therapists are independent professionals. We do not employ, endorse, or supervise any therapist using MoodStride. We are not responsible for the quality of care provided by any therapist.
• The therapist-patient relationship is between you and your therapist, governed by applicable professional and legal standards. MoodStride is only a communication and record-keeping tool.

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to gain unauthorized access to the Service, other users’ accounts, or our systems.
• Reverse-engineer, decompile, or otherwise attempt to extract the source code of the Service.
• Transmit malware, spam, or harmful content through the Service.
• Impersonate another person or entity.
• Use the Service to collect or harvest personal data of other users.
• Interfere with or disrupt the integrity or performance of the Service.

9. Intellectual Property

The Service — including its design, code, text, graphics, and branding — is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

Your content (diary entries, transcripts, mood data) remains yours. By using the Service, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Specifically:

• We do not guarantee that the Service will be uninterrupted, error-free, or secure.
• We do not guarantee the accuracy, completeness, or reliability of AI-generated content (including MindFlow outputs).
• We are not responsible for any decisions you make based on information in the Service.
• The Service is not a crisis intervention tool. If you are in immediate danger or experiencing a mental-health emergency, contact your local emergency services or a crisis helpline.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $50 USD, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Termination

You may stop using the Service and delete your account at any time through the app settings. Upon account deletion, your data will be permanently erased within 30 days, as described in our Privacy Policy.

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. If we terminate your account without cause, we will provide you a reasonable opportunity to export your data before deletion.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the app at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes, you may stop using the Service and delete your account.

15. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the Republic of Poland, without regard to its conflict-of-law principles.

Any dispute arising from or relating to these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of Poland.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.
